As Data Controller, How Do We Collect Your Data
We collect your data when you opt in to receiving our newsletter. We will ask you to enter your email address and verify that you are over 16 years old. We have considered how sensitive the data we are collecting is, and are satisfied that the self-administered age verification process is sufficient.
We also obtained personal information from Backerkit, when the project “Yooka Laylee” reached it goals. This personal data is retained by Backerkit, but we do have access to it and we are able to use it to update you about news, events and offers. The relationship between project creator and backer is detailed in Backerkit’s Terms of Service and available on their website.
How Do We Process Your Data
We will process the data obtained by the various other parties for a number of reasons:
To send you our most recent copy of the newsletter;
To improve the user experience of the Playtonic site.
To make offers to you that we believe will be of interest, relating to our project.
What Is Our Legal Basis For Processing This Information
Data protection law in Europe requires a “lawful basis” for collecting and retaining personal information from citizens or residents of the European Economic Area. Our lawful bases include:
“the processing is necessary for your legitimate interests or the legitimate interests of a third party unless there is a good reason to protect the individual’s personal data which overrides those legitimate interests”
“processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller”
We may also pass your email address to a 3rd party for news and offers relating to the project, where we believe you will benefit, and that you will have a reasonable expectation that we would act in this manner. This information will be treated securely and will only be used for the intended purpose.
Further Processing
If we wish to use your personal data for a new purpose, not covered by this Privacy Policy, then we will provide you with a notice explaining this new use prior to commencing the processing and setting out the relevant purposes and processing conditions. Where and whenever necessary, we will seek your prior consent to the new processing.
Sharing Your Personal Data
As explained, we will share information with selected 3rd parties where we believe you will have a significant interest, and you would reasonably expect us to take this action.
How Long Do We Keep Your Data
Your personal data will not be retained longer than necessary, considering the reason we collected it in the first place. In relation to forum use, your data will be retained for the length of time that you are a member.
Your Rights Regarding Your Personal Data
The GDPR’s introduce new powers for you and your information and we have to make sure we make you aware of them and then let you use them if you wanted to. These include:
You can further see your rights in relation to data here: Rights of the Data Subject – https://ico.org.uk/for-organisations/guide-to-the-general-data-protection-regulation-gdpr/individual-rights/
To Be Informed
Individuals have the right to be informed about the collection and use of their personal data. This is a key transparency requirement under the GDPR.
To Have Access
You are allowed to ask to see the personal data held by us and you can do this by emailing us at love@playtonicgames.com. We may charge for a request for access depending on how much information you want but will let you know this in advance. We will aim to respond to any requests for information promptly, and in any event within the legally required time limits.
To Get Your Data Rectified If Wrong
If your information changes at any time, just email us at love@playtonicgames.com and we will make sure your information is updated.
To Have Your Data Erased
The GDPR introduces a right for individuals to have personal data erased, also known as ‘the right to be forgotten’.
You can make a request for erasure verbally or by emailing love@playtonicgames.com and we will delete your data wherever possible. Sometimes we will need to retain information and we will advise you of this, explaining the reason why we cannot delete your data.
To Limit What Your Data Is Used For
Individuals have the right to request that their personal data is not used. If this right is exercised, you need to be aware that the data will still be stored.
To Restrict Where It Is Sent
The right to data portability allows individuals to obtain and reuse their personal data for their own purposes across different services. Doing this enables individuals to take advantage of applications and services that can use this data to find them a better deal or help them understand their spending habits.
To Object to Processing Data
Individuals have the right to object to:
processing based on legitimate interests or the performance of a task in the public interest/exercise of official authority (including profiling);
direct marketing (including profiling); and
processing for purposes of scientific/historical research and statistics.
To do this you would need to have an objection on “grounds relating to your particular situation”.
After you have informed us of your objection, we will then stop processing your data unless we can demonstrate compelling legitimate grounds for the processing, which override your interests, rights and freedoms; or the processing is for the establishment, exercise or defence of legal claims.
If you wish to exercise any of these rights, please send an email to love@playtonicgames.com.
Complaints
We hope that you won’t ever need to, but if you do want to complain about our use of personal data, please send an email with the details of your complaint to love@playtonicgames.com. We will look into and respond to any complaints we receive.
You also have the right to lodge a complaint with the Information Commissioner’s Office (“ICO”) (the UK data protection regulator). For further information on your rights and how to complain to the ICO, please refer to the ICO website.

As part of the services offered to you through this website, the information which you provide to other software providers may be transferred to countries outside the European Union (“EU”). By way of example, this may happen if any of our 3rd parties servers are located in a country outside of the EU. These countries may not have similar data protection laws to the UK.
